Identity of the contracting parties:

On the one hand, the CUSTOMER, identified on the web site by e-mail address and password, for which he has full responsibility of use and custody, and is responsible for the veracity of the personal data provided to the PROVIDER.

Object of the contract

The purpose of this contract is to regulate the contractual sales relationship between the PROVIDER and the CUSTOMER when the CUSTOMER accepts the corresponding cell during the online purchase process.

The contractual purchase-sale relationship involves the delivery, in exchange for a determined price and displayed on the website, of the product purchased.      

The acceptance of this document implies that the CUSTOMER:

– You have read, understand and comprehend the above.

– You are a person with sufficient capacity to contract.

– You assume all the obligations set forth herein.

These conditions shall be valid for an indefinite period of time and shall be applicable to all purchases made through the PROVIDER’s web site.

Contracting procedure

The CUSTOMER, in order to access the services or products offered by the PROVIDER, must register through the website by creating a CUSTOMER account. Only persons over 18 years of age may register. Therefore, the CUSTOMER must freely and voluntarily provide the personal data required, which will be processed in accordance with the provisions of Regulation (EU) 2016/679, of 27 April (RGPD), and Organic Law 3/2018, of 5 December (LOPDGDD), and detailed in the Legal Notice and Privacy Policy of this website.

The CUSTOMER will select a user name and password, undertaking to make diligent use of them and not to make them available to third parties, as well as to inform the PROVIDER of the loss or theft of the credentials or possible access by an unauthorised third party, so that the PROVIDER may proceed to block them immediately.

Once the CUSTOMER’s account has been created, the CUSTOMER hereby is informed that in accordance with the requirements of article 27 of Law 34/2002, on Information Society Services and Electronic Commerce (LSSICE). 

1. General contracting clauses 

Unless otherwise stipulated in writing, the placing of an order with the PROVIDER shall constitute acceptance by the CUSTOMER of these legal conditions. No stipulation made by the CUSTOMER may differ from those of the PROVIDER if it has not been expressly accepted in advance and in writing by the PROVIDER.

2. Dispatch of orders 

The order will be prepared upon receipt and confirmation of the order, and will be delivered within an estimated period of time, depending on the destination. If the product is not in stock, additional time will have to be added until the item is obtained or manufactured.

Estimated shipping times:

We will do our best to meet these shipping estimates, 99% of orders are placed on time or even earlier, but we cannot guarantee due to the instability of the shipping industry.

The PROVIDER will not send any order until it has verified that the CUSTOMER has made the payment correctly.

The transport and delivery service of the purchased products is always carried out by external and independent companies, so these companies will be the only ones responsible for any damage or prejudice caused to the customer by the provision of the aforementioned services.

The PROVIDER will not assume any responsibility when the delivery of the product does not take place, due to false, inaccurate or incomplete data provided by the CUSTOMER.

The CUSTOMER must verify, in the order confirmation email, that their details are correct in order to receive the product correctly.

The delivery will be considered to have been made when the carrier has placed the products at the disposal of the CUSTOMER and the CUSTOMER, or his delegate, has signed the delivery receipt document. The transport company is only authorised to make goods available to the CUSTOMER AT THE STREET (therefore, if the CUSTOMER lives in an apartment building, penthouse or detached house, the transport company will deliver the goods to the entrance of the building or house, never inside the building, dwelling or private house). If the product after delivery suffers any damage due to having been in the street for some time with the risk of rain, some atmospheric conditions, blows or breakages, etc., as well as during the time that the product is outside the control of the transport agency, the CUSTOMER cannot claim the payment of the product purchased and/or assumes all the damages caused by these circumstances.

In the event that the product has been damaged during transport, the CUSTOMER must communicate this on the same day of receipt of the products. If you detect that the package arrives in poor condition, faults or errors, you must indicate this on the carrier’s delivery note at the time of receipt. Please inspect the package immediately for any damage that may have occurred during transport. 

If you notice after delivery that the package or product has been damaged in transit, you should immediately contact us by telephone on +34 613 97 95 59 or by email at info@forzini.es within 24 hours of receipt of the order: 

– Photos of the damaged items (photo of the package, full photo of the item, close-up photo of the damage)

– Delivery note/receipt clearly mentioning the incident

– Simple request for a full / partial refund / new item

Upon approval from the insurance company, we will start processing your request with a replacement or a full refund at no additional charge. In case the damage is minor and not visible or acceptable, we will inform the insurance company which CUSTOMER is left with the item.

Please do not to book any installer or engage in any preparation work until full receipt of your goods and check that they are in perfect condition.

In the case of returns, we transfer the money paid by CUSTOMER for the purchase to the same account from which payment was received, within a period of 2 weeks.

3. Right of withdrawal

The EU CUSTOMER has a period of fourteen (14) calendar days from the date of receipt of the product to return it (Art. 71 of Law 3/2014 of 27 March). Unless the return is made due to defects in the product, the costs relating to shipping and return shall be bear by the CUSTOMER. The product must be returned in its original packaging, in perfect condition and with all the parts that were in the package.

Due to the nature of our items made of natural stone, unless they arrive damaged or defective, we cannot accept returns for custom or personalised orders. 

Please note that each piece made of natural stone is unique and has natural veins, different colours, shades, holes, micro-cracks whose patterns vary from stone to stone. And since each piece is unique, variations in tone, colour, grain and pattern are to be expected, are part of the product and are not considered as defects.

The right of withdrawal shall not apply in the following cases:

– If the product is not presented in perfect condition.

– If the packaging of the product is not the original or is not in perfect condition. The original packaging must protect the product so that it is received in perfect condition, and the use of seals and adhesive tapes applied directly to it is prohibited.

– When the product has been opened without being able to demonstrate that it has not been used.

– When they are personalised products or those exempted for reasons of hygiene or other exceptions legally provided for in Art. 103 of Law 3/2014, of 27 March.

Exchanges and returns:

In the event of incorrect deliveries or products with manufacturing defects, PROVIDER will proceed to resend the order, taking charge of the shipping costs.

Shipping costs will only be refunded in the case of incorrect delivery or products with manufacturing defects.

Customs and import taxes for international orders outside the EU.

The CUSTOMER is responsible for any customs and import taxes that may apply (normally our shipping partner will contact you and send you the customs taxes that you have to pay). We are not responsible for any delays that may occur due to customs.

4. Legal guarantee 

All our products are guaranteed for 2 years in accordance with the law in force concerning the guarantee on the sale of consumer goods for domestic use.

Excluded from the guarantee are defects that have their origin in:

– Inappropriate use or maintenance, inadequate or out-of-specification of the product (recommendations for proper maintenance of natural stone articles are indicated in each product’s data sheet).

– Unauthorised modifications.

– Abuse, neglect, accident, loss or damage during transport.

– Unauthorised maintenance or repair.

– Products whose packaging and contents are not in perfect condition.

5. Price and period of validity of the offer

All prices, unless expressly stated otherwise, do not include the costs of shipping, handling or any other additional services and annexes to the purchased product. Shipping costs are shown separately depending on the delivery destination. The prices of each product are shown in euros including VAT.

PROVIDER does not assume any graphic or numerical error that may occur due to the maintenance of the website and reserves the right to cancel any order for this reason or for other reasons beyond the company’s control, returning any amount previously received. The prices shown may be modified without prior notice.

Protected web site: We guarantee confidentiality in the transfer of data on the Internet. We use the security protocol, SSL (Secure Sockets Layer) supplied and certified by our hosting provider. Thanks to the SSL security certificate, your customer data (username, password, purchase data, etc.) will be encrypted on the server and the security of your communications will be guaranteed. In the event that you make your payment through our website via payment gateways we do not access this information in compliance with the regulations, your data will be sent directly through the payment gateways to the payment service provider.

8. Resolution of disputes

Applicable legislation and competent jurisdiction:

Purchases and sales made on https://www.forzini.com are subject to Spanish legislation.

In the event of any conflict or discrepancy arising in the interpretation or application of these contractual conditions, the Courts and Tribunals which, where applicable, will hear the matter, will be those provided for in the applicable legal regulations regarding competent jurisdiction, in which, in the case of consumers, the place of fulfilment of the obligation or the place of domicile of the purchasing party is taken into account.

In the event that the purchasing party is domiciled outside Spain, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Zaragoza.
