2. Object of the Contract

These Terms & Conditions regulate the contractual sales relationship between the PROVIDER and the CUSTOMER when the CUSTOMER completes and accepts an order through the Website.

The purchase contract involves the delivery of the selected product in exchange for the price displayed on the Website at the time of purchase.

By accepting these Terms & Conditions, the CUSTOMER declares that:

  • They have read, understood, and agree to the content.

  • They have the legal capacity to enter into contracts.

  • They accept all obligations set forth herein.

These conditions remain valid indefinitely and apply to all purchases made through the Website.Ā 

3. Contracting Procedure

To access the products or services offered by the PROVIDER, the CUSTOMER must create an account on the Website. Registration is permitted only for individuals aged 18 or older.

The CUSTOMER must voluntarily provide the personal data required, which will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), as detailed in the Website’s Legal Notice and Privacy Policy.

The CUSTOMER shall choose a username and password and agrees to:

  • Use them diligently.

  • Keep them confidential and not share them with third parties.

The CUSTOMER is solely responsible for maintaining the confidentiality and security of their login credentials. The PROVIDER does not have access to the CUSTOMER’s password and cannot modify or reset it. In case of loss, theft, or suspected unauthorised access, the CUSTOMER must update their password immediately through the Website’s account‑management tools. Upon request, the PROVIDER may delete the CUSTOMER’s account.

Once the CUSTOMER account is created, the CUSTOMER is informed, in accordance with Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), of the steps involved in the electronic contracting process.

4. Nature of Products – Natural Stone & Visual Representation

All products sold are made from natural stone and are therefore unique. Variations in colour, veining, texture, pattern, porosity, tone, natural markings and cavities are inherent characteristics of natural stone and do not constitute defects. Product images, videos, samples, or descriptions shown on the website or in marketing materials are for illustrative purposes only and represent a model or example, not the exact item that will be delivered. Such natural variations, or minor differences between the delivered product and any visual representation, shall not be considered grounds for complaint, return, refund, or replacement.

5. Dispatch of ordersĀ 

The order will be prepared upon receipt and confirmation of the order, and will be delivered within an estimated period of time, depending on the destination. If the product is not in stock, additional time will have to be added until the item is obtained or manufactured.

Estimated shipping times:

We will do our best to meet these shipping estimates, 99% of orders are placed on time or even earlier, but we cannot guarantee due to the instability of the shipping industry.

The PROVIDER shall only process and dispatch orders once full payment has been correctly received and verified. The PROVIDER reserves the right to cancel or suspend any order where payment verification is incomplete, failed, or suspected of fraud.

The transport and delivery of products are carried out by independent third-party carriers. The PROVIDER is not responsible for delays, damages, or incidents caused exclusively by the carrier, except where mandatory consumer law requires otherwise.

Delivery shall be deemed completed when the carrier makes the products available to the CUSTOMER at the delivery address provided and the delivery receipt is signed by the CUSTOMER or their representative.

Delivery is strictly curbside / street-level only.
Carriers are not authorised to deliver inside buildings, dwellings, apartments, or private properties.

Once the products have been physically delivered and made available at the agreed location, the risk of loss or damage passes to the CUSTOMER, except where mandatory consumer protection law states otherwise.

The PROVIDER shall not be liable for damage occurring after delivery, including but not limited to exposure to weather conditions, rain, humidity, impacts, improper storage, handling, theft, or any other circumstances outside the control of the carrier or PROVIDER.

The PROVIDER shall not be liable for non-delivery, delayed delivery, or additional costs resulting from false, inaccurate, or incomplete delivery details provided by the CUSTOMER.

The CUSTOMER is responsible for verifying that all personal and delivery details included in the order confirmation email are correct.

6. Inspection Upon Delivery & Transport Damage Claims

The CUSTOMER shall inspect the external packaging and the product itself immediately upon delivery, without undue delay, and in any event within 24 hours of delivery.

Inspection should be carried out before the carrier leaves where reasonably possible. The CUSTOMER acknowledges that the carrier is not obliged to wait and that this does not extend the inspection or notification deadlines set out herein.

Reporting Visible Damage at Delivery:

If any visible damage, defects, or irregularities are detected on the packaging or the product:

  • The CUSTOMER must clearly record the issue on the carrier’s delivery note at the time of receipt.
  • The CUSTOMER must notify the PROVIDER on the same day of delivery.

Reporting Hidden Damage (Inside Packaging):

If damage is discovered after opening the package, the CUSTOMER must notify the PROVIDER within 24 hours of delivery by:

Damage reported more than 24 hours after delivery may limit the PROVIDER’s ability to file a transport‑damage claim with the carrier. In such cases, the CUSTOMER must provide clear evidence that the damage existed at the time of delivery.

Required Documentation for Any Claim.

To process a claim, the CUSTOMER must provide:

  • Photos of the damaged packaging
  • A full photo of the product
  • Close‑up photos of the damage
  • A copy of the delivery receipt clearly noting any incidentĀ 
  • A brief written request indicating whether a replacement, partial refund, or full refund is requested

Claims submitted without the required documentation may be rejected.

6.1. Failure to Report on Time

Failure to comply with the above reporting requirements may result in the claim being rejected, as the carrier’s insurance may not accept late claims.

6.2. Natural Stone Tolerances

As all products are made from natural stone:

  • Variations in colour, veining, texture, pattern, cavities, or minor surface irregularities are inherent characteristics of the material and do not constitute defects.
  • If the reported issue is assessed as minor, cosmetic, or within normal natural‑stone tolerances, the item will be considered compliant with the contract and no refund or replacement will be provided.
  • Many natural stones contain small cavities, fissures, pores, or structural irregularities. During production, these may be filled or reinforced with resins, sealants, or similar materials to ensure stability, hygiene, and proper functionality of the finished product. Such treatments are standard industry practice and form an integral part of the product. They do not constitute defects, repairs, or grounds for complaint, return, refund, or replacement.

7. Returns & Refunds.

Where a return or refund is accepted in accordance with applicable law, refunds shall be issued using the same payment method originally used, within a maximum period of 14 days from confirmation of the refund approval

8. Right of withdrawal

EU Customers:

Customers resident in the European Union have the right to withdraw from the purchase within fourteen (14) calendar days from the date of receipt of the goods, in accordance with applicable EU consumer protection legislation. This right applies only to consumers (not businesses) and only to eligible products as defined in these Terms & Conditions.

UKĀ  Customers:

Customers resident in the United Kingdom have the right to cancel the purchase within fourteen (14) calendar days from the date of receipt of the goods, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This right applies only to consumers and only to eligible products as defined in these Terms & Conditions.

Customers Outside the EU and UK:

For customers outside the European Union and the United Kingdom, no statutory right of withdrawal or cancellation applies, unless expressly required by mandatory local law. Any returns, cancellations, or refunds for such customers are accepted solely at the PROVIDER’s discretion, and only under the conditions expressly stated in these Terms & Conditions.

8.1 No Extension or Expansion of Rights

Nothing in these Terms & Conditions shall be interpreted as granting withdrawal, cancellation, or refund rights beyond those expressly required by applicable mandatory consumer law. Where no such mandatory rights exist, all sales are considered final unless otherwise agreed in writing by the PROVIDER.

9. Exchanges and returns

Return Conditions:

Unless the withdrawal is due to a defective or non-conforming product, the following conditions strictly apply:

All return shipping and handling costs shall be borne by the CUSTOMER.

The product must be returned:

  • Product must be unused, uninstalled, unaltered, and in perfect resale condition
  • In its original, complete, and undamaged packaging
  • Product must be fully protected for transport, ensuring it arrives without damage.
  • With all accessories, components, documentation, and protective elements originally supplied

The CUSTOMER shall be liable for any diminution in value of the product resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

10. Exclusions from the Right of Withdrawal

The right of withdrawal shall not apply, or may be partially refused, in the following cases (as permitted by law):

  • Where the product is not returned in perfect condition, shows signs of use, damage, installation, alteration, or improper handling
  • Where the original packaging is missing, damaged, incomplete, or unsuitable to ensure safe transport
  • The product must be returned in its original packaging, including all protective materials, films, padding, and securing elements applied by the PROVIDER at the time of shipment.
  • Due to the natural and porous characteristics of stone, the CUSTOMER must not apply any adhesive tape, labels, seals, markings, protective films, or fastening materials directly onto the product, nor remove, replace, or alter any protective elements originally applied by the PROVIDER.
  • Any return where the original packaging has been modified, damaged, substituted, or rendered unsuitable for safe transport shall be deemed non-compliant and may result in refusal of the return or a reduction of the refundable amount.
  • Where the product has been opened or unpacked and the CUSTOMER cannot demonstrate that it has not been used, installed, or altered
  • Where the product has been custom-made, personalised, or manufactured to the CUSTOMER’s specifications
  • Where the product falls under any other statutory exception to the right of withdrawal, including those provided for under Article 103 of Law 3/2014 of 27 March (or equivalent UK legislation)

11. Refunds Following Withdrawal

If the withdrawal is accepted:

  • The refund shall be issued using the same payment method used for the original transaction

  • The refund shall include the price paid for the product and, where required by applicable law, the cost of standard outbound delivery (excluding any additional costs for express, premium, or non-standard delivery options).

  • Return shipping costs shall be borne by the CUSTOMER, unless the return is due to a defect or non-conformity.

  • The PROVIDER reserves the right to withhold reimbursement until the goods have been received and inspected

Where the returned product does not meet the required conditions, the PROVIDER reserves the right to:

  • Refuse the refund entirely, or

  • Apply a partial refund reflecting the loss in value

12. Incorrect Deliveries & Manufacturing Defects

In the event of:

  • an incorrect delivery attributable to the PROVIDER, or

  • a manufacturing defect verified after inspection

the PROVIDER will, at its discretion:

  • replace the product, or

  • issue a full refund of the price paid.

In such cases, the PROVIDER will bear the cost of return shipping and, where applicable, the cost of sending a replacement.

No additional shipping costs (including express delivery upgrades or special handling requested by the CUSTOMER) shall be refunded unless expressly required by mandatory consumer protection legislation.

13. Customs and Import Taxes for Orders Outside the EU

For all international orders shipped outside the European Union, the CUSTOMER is solely responsible for any customs duties, import taxes, brokerage fees, or other charges imposed by the destination country. These fees are not included in the product price or shipping cost.

Our shipping partner will normally contact the CUSTOMER directly to arrange payment of any applicable customs charges. Failure to pay these charges may result in delays, storage fees, or the return of the shipment, for which the PROVIDER accepts no responsibility.

The PROVIDER is not liable for any delays, additional costs, or delivery issues caused by customs procedures, inspections, or import regulations in the destination country.

If the shipment is returned due to unpaid customs fees or refusal by the CUSTOMER to accept the parcel, all associated costs (including return shipping, customs charges, and handling fees) will be deducted from any refund, or the PROVIDER may refuse a refund entirely where permitted by law.

14. Legal Guarantee

All products are covered by a 2‑year legal guarantee of conformity, in accordance with applicable EU and UK consumer protection legislation. This guarantee applies exclusively to manufacturing defects and non‑conformities that existed at the time of delivery, as required by law.

Because the products are made from natural stone, the CUSTOMER acknowledges and accepts that the following characteristics are inherent to the material and do not constitute defects, non‑conformities, or grounds for any claim:

  • Natural variations in colour, veining, pattern, texture, porosity, or tone

  • Natural fissures, pitting, micro‑cracks, or cavities

  • Resin fills, sealants, bonding agents, reinforcements or other professional techniques used during production

  • Minor surface irregularities or dimensional tolerances typical of handcrafted stone

  • Differences between the delivered product and website images, samples, or displays

The legal guarantee does not apply in the following situations:

  • Improper use, handling, installation, or maintenance, including failure to follow the care instructions provided

  • Damage caused by impact, accident, negligence, or inadequate storage

  • Damage occurring after delivery, including during transport arranged by the CUSTOMER

  • Alterations, modifications, or repairs carried out by unauthorised persons

  • Products returned without original packaging or with packaging or contents not in perfect condition

  • Normal wear and tear consistent with the nature of natural stone

The PROVIDER reserves the right to inspect the product to determine the origin and nature of any reported defect. If the inspection confirms that the issue is not a manufacturing defect or pre‑existing non‑conformity, the claim will be rejected.

15. Price and Taxes

Product Prices:
All prices, unless explicitly stated otherwise, are exclusive of shipping, handling, or any additional services related to the purchased product. Shipping costs are displayed separately based on the delivery destination.

VAT and Taxes:

For customers in the European Union, prices are shown in euros including applicable VAT.

For customers outside the European Union (including the United Kingdom, the United States, and other countries), VAT is not applied, and customers are responsible for any import duties, customs fees, or local taxes that may be due in their country.

Website Accuracy and Errors:
The PROVIDER does not assume responsibility for typographical, graphic, or numerical errors that may appear on the website.

Right to Cancel Orders:
The PROVIDER reserves the right to cancel any order due to pricing errors or other reasons beyond its control. In such cases, any amounts already paid by the CUSTOMER will be fully refunded.

Price Changes:
All prices are subject to change without prior notice, except for orders that have been confirmed and paid in full.

We take the confidentiality and security of your data seriously.

Secure Data Transfer:

For consumer customers, this generally corresponds to the place of performance of the obligation or the customer’s domicile.

    For customers domiciled outside Spain, both parties expressly submit, with waiver of any other jurisdiction, to the Courts and Tribunals of Zaragoza (Spain).
